Terms of Service

1. Who we are, who you are

"Attest" / "we" / "us" / "our" means Attest, an ECTD product, operated by Jason as a sole trader under ECTD Holdings, in Queensland, Australia.

"You" / "your" means the person, business, or autonomous agent (acting for a principal) buying or using an Attest deliverable.

By buying or using an Attest deliverable you accept these Terms. If you do not accept them, do not buy or use the deliverable.

2. What Attest sells

Attest sells structured assessments and machine-readable documents about how ready a service is to be discovered, priced, paid for, policy-controlled, and audited by autonomous AI agents.

Current paid deliverables (per services/pricing.json):

  • Agent Commerce Readiness Report (USD 29) — PDF + JSON twin scoring a service across six dimensions.
  • Manifest + Policy Pack (USD 99) — the above plus five machine-readable JSON files drafted for your service.
  • Endpoint Kit (USD 299) — the above plus OpenAPI notes, agent-docs draft, flow diagrams, and an implementation checklist.

Delivery target: ≤24 hours after we have both your payment and your intake answers, for Tiers 1 and 2; ≤48 hours for Tier 3.

3. How a purchase forms a contract

A binding contract forms when:

  1. You complete payment via the Stripe Payment Link for the tier you bought, and
  2. We send you our confirmation email asking for your intake answers.

Until both have happened, no contract exists, and you can stop the process at no cost.

4. What we will do

We will:

  • Send your deliverable within the SLA above, by email
  • Run every deliverable through a multi-stage quality review before sending it — automated scoring against our published rubric, with escalation to a human reviewer for any deliverable that falls below our quality threshold
  • Use the information you submit only to deliver and improve your purchase, per our Privacy Policy
  • Refund per the Refund Policy when applicable

5. What you agree to do

You agree to:

  • Submit accurate intake answers in good faith
  • Use the deliverable for your own service, your client's service, or a service you have authority to assess — not for systematically harvesting our methodology to resell
  • Not use the deliverable for any unlawful purpose or to assess any service prohibited under our Acceptable Use Policy
  • Pay the price stated on the Stripe Payment Link at the time of purchase

6. Intellectual property

We retain all rights, title, and interest in our assessment methodology, scoring rubric, template structure, schemas, and aggregated benchmarks.

When we deliver your report or pack, we grant you a perpetual, non-exclusive, non-transferable licence to:

  • Use the JSON files in your own infrastructure (drop into your /.well-known/ or /services/ path, hand to engineers, build against them)
  • Quote or paraphrase the PDF report internally and with your direct customers, suppliers, or counsel
  • Republish your report on your own website or in your own materials with attribution to Attest

You may not:

  • Resell the report or pack as a standalone product
  • Strip attribution and present the methodology as your own
  • Train a derivative scoring service on our deliverables at scale

7. AI-assisted deliverables

Deliverables are AI-assisted and pass a multi-stage quality review before sending: automated scoring against our rubric, with deliverables that fall below our quality threshold escalated to a human reviewer. They are structured assessments based on your inputs and on publicly available conventions in the agent commerce space. They are not professional legal, financial, taxation, security, or compliance advice. Acting on them is your decision.

8. Refunds, support, complaints

  • For an Australian Consumer Law (ACL) complaint, contact us first; if unresolved, you may complain to your relevant fair-trading or consumer authority.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right you have under the Competition and Consumer Act 2010 (Cth) including the ACL.

9. Liability

To the maximum extent permitted by law:

  • Our total liability to you in connection with a deliverable is limited to the amount you paid for that deliverable
  • We are not liable for indirect, consequential, or special losses, including lost revenue, lost data, lost opportunity, or third-party claims arising from your implementation of the deliverable
  • Nothing in this clause limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited

For Australian consumers, our goods and services come with non-excludable guarantees under the ACL. The limitation above does not apply to the extent ACL would override it.

10. Suspension and termination

We can refuse, pause, or terminate service if:

  • You breach these Terms (including the Acceptable Use Policy)
  • Payment is reversed, charged back, or fraud-flagged
  • We are required to by law or by Stripe

If we terminate for breach, refunds are at our discretion and may be limited per the Refund Policy.

11. Agent buyers

Where an autonomous agent purchases on behalf of a principal, the principal is the contracting party and is responsible for the agent's actions, the intake answers submitted, and the use of the deliverable.

12. Changes

We may update these Terms. We will post the new version here and update the Effective date. Material changes will be emailed to active customers.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. Disputes are subject to the non-exclusive jurisdiction of Queensland courts.
